All sales made through Something Italian are subject to these Terms and Conditions

APPLICABLE LAW

Our site is operated and controlled in England. The relationship between us and all matters connected with the site and any order are governed by English Law. You submit to the exclusive jurisdiction of the English courts in relation to all matters connected with our relationship the site and any order or contract between us.

Contract

The present Terms and Conditions are incorporated in all contracts of sale between you and Something Italian. We are not registered for VAT.

Price

All prices and delivery costs displayed on the Website are quoted in pounds Sterling. We make every effort to ensure that the prices shown on our Website are accurate. All prices stated but do not include delivery charges that shall be charged at the rates applicable at the time of placing your order. The delivery charges are explained on our Delivery page.

Delivery

UK Shipment of the goods will be made within 2 - 4 working days following the order placed on our website. deliveries to Europe and North America 4 - 5 working days, deliveries to Rest of the World 5 - 7 working days.

Payment

Payment may be made in Pounds Sterling by MasterCard, Visa, Visa Delta, Switch or American Express. The holder of the credit or debit card which is used for the payment of goods purchased is fully liable for all sums charged. Completing the payment information and submitting the order implies authority to debit the relevant card. Something Italian will take all reasonable care to keep your order and payment details secure. Payment for the order using a credit or debit card is done using a secure (encrypted) link to the leading Internet credit card payment agency. We apologize that the architecture of the Website using frames causes a technical limitation and the little padlock on the bottom right hand corner of your screen will not appear, but the links to WorldPay and to Paypal are secure ones and you can use them in all confidence.

Title and Risk

Property and title in and to the goods ordered by you shall remain with Something Italian until full payment in cleared funds for the price of the goods and all ancillary costs has been received and the goods have been dispatched to you. The goods shall be at your risk as from the time when they have left our premises.

Availability

All goods featured on our Website are subject to availability and Something Italian reserves the right to withdraw certain goods at any time without notice. If we are unable to fulfill an order (in whole or in part) we will advise you of this by e-mail or phone; you will then be given the opportunity to cancel your order. If we are unable to contact you, we reserve the right to dispatch the available part of your order and to deliver the balance of said order at a later date (with no further delivery charges). Something Italian reserves the right to discontinue supplies of goods featured on our Website at any time and excludes all liability in respect of any claim whatsoever arising therefrom.

Formation of Contract

An order submitted by you via our Website is deemed to be an offer to purchase goods from Something Italian as seen on the Website. No contract shall be formed between Something Italian and you unless and until we despatch the goods to you. We may, at any time prior to dispatch of the goods, decline to accept your order for any reason. Once you have placed your order, we will send you an e-mail confirming receipt of your order. This e-mail is only intended to confirm receipt of your order and is not intended to constitute acceptance of your order by Something Italian.

Cancellation

We operate a 'No Quibble' policy for cancellation to allow you a cooling off period after placing your order. You may cancel your order for any reason provided:

1. You notify us of your cancellation in writing/email to the address at the foot of this page within fourteen working days of delivery.
2. The goods remain unused and component parts are unopened.
3. You or the recipient retain and take reasonable care of the goods
4. We regret that you may not cancel an order containing foods once  the order has been dispatched. 
5. We will refund your original delivery charge when a product is faulty or damaged except for foods. (Your claim must be submitted to us within 14 days of receiving the item)

Sales Guarantee for non Food/Drink Items

In addition to manufacturers' warranties we will offer a full refund or replace, free of charge, any item which, through manufacturing defect, becomes unusable within 12 months of delivery. Contact us at the address at the foot of this page. (Exceptions: we won't replace broken or chipped Caffe del Doge, Deruta or Margherita Rossetto ceramics if your claim is not submitted to us within 14 days of receiving the item)

Claims

Claims for breakages or other damage should be made on Tel. no. +44 (0) 8007833397 (Free 0800 in the UK), or by e-mail within 48 hours of receipt. You must e-mail us images of the damaged item so we can assess your claim.

Substitution

All hampers, baskets and gift boxes are fully itemized and fairly described on this website and we will make every effort to supply the items described in the detailed listings. However, in the event of supply difficulties, we reserve the right to substitute any items with replacements of at least equal quality and value.

Returns & Exchanges

If by misadventure you should not be fully satisfied with our products, and should they not be of a nature to deteriorate or expire rapidly, you have the right to cancel your order by giving written notice to us (by e-mail, fax or post) at the address given below at any time from placing your order within 14 days from reception of the goods. In such case we will make a full refund to the value of the goods within 30 days from the date of cancellation. The cost of returning the goods to us will be born by you. On such cancellation, Something Italian shall accept such goods only if they are returned to Something Italian the same condition as the original delivered goods. We decline all responsibility in the case of goods of a nature to deteriorate or expire rapidly. Please complete the form supplied with your order. Be sure to fill in all the details and enclose it with your package. If you don't have your invoice, please write the order number on a separate sheet of paper and enclose it with the package so that we can trace your order history. Force Majeure

Something Italian shall not be liable for any delay or default in the execution of its obligations in the case of any event outside its control including but not limited to natural disasters, bad or inclement weather, fires, explosions, floods, failure or delay of third party suppliers, computer or software errors, national or local strikes or stoppages, accidents, riots or civil uprisings.

The Website makes use of two secure credit card payment gateways: Worldpay and Paypal. We do not have access to your credit cards details.

Headings in these terms and conditions are for convenience only and have no legal meaning or effect. If any of these terms and conditions is found to be invalid by any court of competent jurisdiction the invalidity of that term or condition will not affect the validity of the remaining.
